The poem begins with Mirabai exalting the Yogi, to be interpreted as Krishna, and she refers to him as "my friend, the clever one/ whose mind is on Siva and the Snake." Mirabai portrays herself in this poem as a yogini to the yogi. She talks of coming home, which can be interpreted as going with God, an idea that is prevalent in much of Hinduism. The themes of God and love are also very present throughout the poem. In line 8, the poet states "take me, guard me with your guardian mercy/ please." The message of this poem is that the author would do anything to be with the all-knowing yogi, including giving up her mind and body. I had to register for the physical fitness this summer which l believe is a great start on my journey towards achieving complete physical fitness. Esther and Book of Job Comparison Essay In one of the assigned readings, I came across story of a Jewish woman named Esther who had suffered from cancer. The uniqueness of her journey touched me incredibly when I learned about her own personal struggle with the disease. It is an amazing but sad story in the sense that Esther copes with her cancer in a shame related way, believing that she is suffering from her sins. Esther is unhappily married and ends up having an affair with her boss, and she perceives cancer as a punishment from God for her sin. As told in the story written by Dr, Jerome Groopman in book the â€Å"The Anatomy of Hope†, Esther waits quite a long time before seeking treatment, and her tumor is very large before she decides to receive medical attention. The author of the books shares his own experience as a resident in the hospital, getting into depth about her family issues, problems, and reactions to her illness. Esher’s character can be compared with similar reading from the bible called â€Å"Book of Job† in that both characters believe to be suffering by the hand of Satan, although this is not true in reality. In this particular reading, Satan comes to accuse wealthy Job before God. He insists that Job only serves God because God protects him, and Satan seeks God’s permission to test Job’s faith and loyalty. In Satan’s test, Job loses his wealth, family and health. Three of his friends come to try to comfort him and keep telling him that his tragedy is a punishment for past sins in his life. At this point, I was able to notice similarities to Esther’s experience in that she saw cancer as punishment for her infidelity. In the old testament of the Bible, Job’s friends tell him that he needs to remain humble and allow God to purify his life. Like Job, Esther is torn between believing in God’s punishment and willing to bet better. At first, she seeks the treatment way too late, but at least she does. She shares her secret with Dr. Groopman within a health venting session, also part of the healing process, and at this part we get to know Esther as a person not just as patient. Furthermore, after the dinner at Esther’s house and the significance of her husband’s prayer, Esther feels so guilty that she never follows up with her appointment and stops the rest of the treatment. Like Job, Esther is torn apart by her belief that she should suffer and often loses the will to place faith in God and hope for better health. The story of Esther ends tragically due to Esther’s unyielding feelings of guilt. She lost the battle with cancer and died after receiving treatment in the most advanced stage of the disease. On the other side, in the Bible, Job questions God and learns the valuable lesson about the sovereignty of God and his need to trust in Lord. After Job places trust in God, his prosperity and health returns. Here is where Esther and Job differ. While Job regains his faith and his prosperity, Esther is continually haunted by shame and consequently loses her health. I think that God’s desire was to purify Esther, and that could be reason behind her disease, but Esther not seeking treatment was her own negative way of coping with the sin. Esther did not believe in God’s will, for her to be purified, and she suffered until her death. In my opinion, Esther was so focused on the idea of punishment that she missed the whole point of purifying her soul. I think of God as the greatest, and it is hard for me to believe that our Lord would want Esther to suffer without the treatment. Job in the bible submitted himself to God and regained his lost goods, but Esther did what she believed was right but she ended up dying at the end. Esther did not want to receive chemotherapy thinking she did not deserve it, and her mind was full of doubt. Both characters achieved purity at the end, but Esther’s was not aware of it. She allowed punishment and suffering to continue. The lesson from the bible is that we need to trust and obey God. Some things cannot be thoroughly explained in human terms, but we still need to always submit to His good will.

It’s another crisp blue morning in the town of Flagstaff. Two Dogs bark protectively from across the street warning a passer by not to shit in our neighborhood. In my mind Flagstaff is not a solid place, it is continually changing. As I’ve been getting older, my perception of Flagstaff has been growing too. I’ve been coming up to Flag since I was ten years old. At that time, the town felt so old and rustic. It was a place where one could escape from the desert heat, from sitting through boring Sunday sermons, and from the monotony of everyday life. I would come up every weekend with friends to climb in the surrounding canyons. This was our training ground for many years. Bouldering in the forest with beers and buds proved to be an excellent way of getting stronger. Flagstaff was a place where we could push our limits, work on projects and achieve incredibly rewarding goals. Although climbing was always our main priority, we felt that it was important to balance the anguish of rock climbing with the relief of Advil and cold beer. This is where the construction and corruption of my character began. As my friends got older, they began migrating north for college and a new era of Flagstaff emerged. I still came up on weekends to go climbing, but people were becoming harder to motivate. I guess it was half to do with the fact that the climbing was so accessible that you could just go climb any time you wanted, but a new force was also emerging. It came to be known as the â€Å"Evil Party Vortex†. It was a strong gravitational pull which had shifted our focus from climbing to boozing. Late nights lead to shorter days. We seldom got out of the house before 1:00. Coffee intake was so extreme that when you finally got out to the rocks, nervous tremors would shake you off the wall. My climbing was going down hill. I really wanted to move up to join my friends in pursuits of drunken belligerence, yet at the same time I really wanted to travel and rock climb. After I graduated from high school I knew I would be going to NAU, but not right away. I was originally just going to take one year off, but I ended up taking two. I was always searching for the next challenging adventure.

Case Study Analysis Essay

The case study I chose to evaluate was Oak Brook Medical Systems, Inc. The manager, Jackie, is known as a â€Å"no nonsense† kind of manager who is credited with large increases in business accounts resulting in a $40 million dollar addition to the corporate bottom line. She is a valuable corporate asset but has considerable communication issues with staff members. This is a so called â€Å"armchair† case study that is based on the fictional documentation produced by O’Rourke in case 10-1 (2010) Business Problem Part of the problem faced by Oak Brook Medical Systems is Jackie. She is difficult to communicate with and on occasion, makes other staff members feel their contribution to the welfare of the company is less important than her own. Workers feel unappreciated and Jackie is sometimes short tempered and condescending toward her coworkers and subordinates. Jackie believes the issue to be no more than a hurdle that has been faced by many who went before her. She believes that the issues with her subordinates are no different than those faced by every manager or superior, not suspecting that the issue may actually lie with her. From Jackie’s perspective, the staff problems are due in part to her race. Jackie is of African American descent and, as such, is perhaps a little more observant of people’s attitude toward her than other employees would be. She is beginning to believe that the company may prefer to have a non-black in the position she currently holds; and would rather she not advance any further with the company. Jackie has known nothing but success in her life and is having difficulty recognizing hurdles to advancement because she has not faced failure in her past. She cannot understand the reason she is not progressing more within the company and does not consider her communication issues with fellow staff members as anything more than a nuisance to her advancement. The business problem for Oak Brooke Medical Systems is how to improve communication between staff members and prevent Jackie from demeaning her subordinates by her very direct approach to management. Critical Issues The issues faced by Oak Brooke Medical Systems, Inc., are related to communication and human resources. If staff feels they have no support in dealing with an overly aggressive manager, the company will lose vital talent and the creativity of the remaining members may be inadvertently subdued by fear or perceived bullying. The loss of current staff members could pose a long-term problem for the company as attracting and cultivating talented team members is costly and time consuming. If Jackie can eliminate one or more of the other members of the team by her aggressive managerial stance, she may ultimately cost the company more than she generates in revenue. Jackie is also a talented team member; but tends to want to play alone and seldom seeks the approval of other staff members. She has a direct approach to management and can steam-roller over others to reach her goal. She is African American and this will ultimately become an issue should the company decide to discipline her for unacceptable behavior. In the short term, Jackie believes her color is hindering her advancement within the company. Possible Solutions Jackie is exceptional at producing profits for the company. If Oak Brooke was willing to invest further in Jackie and provide some cultural training and sensitivity classes she may benefit. If Jackie can make other team members feel their contribution is important and indeed welcome, she may be able to generate a wave of support rather than create an unpalatable hostility in the workplace (Vlachoutsicos, 2011). Staff members may also benefit from cultural training and perhaps they would be more accepting of Jackie’s stance with regard to upward mobility in the corporation. IF team members understood the perceived hurdles Jackie faced in her work, they may be able to accommodate slightly more than they are currently able to. Meetings to openly discuss issues that staff have with Jackie and vice versa, may be all that it takes to settle the workplace down to something more easily managed. According to O’Rourke (2010), we all judge people by a standard to which we are accustomed and that standard is set by our experiences, values, education, and beliefs. Being able to recognize differences in the experiences of others is a big step toward building the bridges to successful communication. Racial bias is a two-way street and it should be made clear to all involved in the resolution that they must each understand the issue from the perspective of the other party or negotiations will be futile. Advantages That Multinations Have Over Domestically Focused Companies

In this age of globalization, companies are seeking to expand businesses across borders and consequently there are more and more multinational companies. A multinational corporation is one that is based in one country while maintaining manufacturing facilities or operations offices in other countries and markets its products or services on an international basis. A multinational corporation is able to take advantage of special economically advantageous opportunities that exist in the countries where it operates, such as a low labor cost or favorable rate of currency exchange.They also enjoy access to a diversified workforce that gives them greater creative competitive edge. The reasons why companies seek to expand across borders are: to open new markets or to hold onto existing ones; to avoid tariffs or other trade restrictions; to tap new sources of raw materials and agricultural production; and to take advantage of cheap foreign labor. The most significant aspect of multinational c orporations is that they enjoy major tax and investment advantages. Tax Advantages: Business taxation varies from country to country.While there are high tax countries like the United States, Great Britain and the People's Republic of China (PRC), there are low tax countries like Belize, the Cayman Islands and the Bahamas. A multinational corporation can pick its tax jurisdiction and thus limit its tax obligations. Doing so translates instantly into greater profits. Lowering Taxes:Most multinational corporations look for tax holidays when seeking a foreign base for their manufacturing plant. Multinational companies enjoy the advantage of having the choice to get the best combination of location, labo r market, and government corporate benefits. Funding opportunities: Multinational corporations have regular access to funding opportunities unavailable to domestic companies.The money provided by the government in return for creating jobs reduces the multinational corporation's overhead, diminishes business risk and increases profits. It has been found that any company with an established export market outside of the manufacturing country's domestic market can recover most – almost 50-75% – of the expenditure in setting up a new plant. Tariffs Can Be Circumvented: Multinational corporations can dodge tariffs by proper planning.If a MNC wants instant free trade access to both the EU and the USA, it will start manufacturing in Israel. If there is a low-tech product that needs free trade access to the EU, it is best to make it in Senegal, since they have a free trade agreement with France. Accounting advantages: Multinational pooling arrangement is an agreement between the head office of a multinational company and an insurance network, which allows – at an accounting stage – the consolidation of the worldwide experience.This network allows: better management of the worldwide risk and improved reporting; up-front local savings due to economies of scale and potential international dividends; improved local terms & conditions due to network leverage; easier transfer of employees within the entity and reinsurance protection against individual peaks or catastrophic events (DF, 2006). Advantage of Transfer Pricing: When one part of a multinational organization in one country transfers goods, services or know-how to another part in another country, the price charged for these goods or services is called ‘transfer price'.This may be a purely arbitrary figure, meaning by this that it may be unrelated to costs incurred, may be unrelated to operations carried out or to added value. The transfer price can be set at a level which reduces or even cancels out the total tax which has to be paid by the multinational. In other words it is possible for a multinational company to minimize its liability for corporation tax by transfer pricing (Davidmann, 2006). According to the US law, multinational corporations, whether American- or foreign-owned, are supposed to pay taxes on the profits they earn in the United States.However, in reality, foreign-owned corporations doing business in the United States, typically pay far less in U. S. income taxes than domestic companies. Even U. S. -owned multinationals utilize such tax evasion loopholes. Companies try to set their â€Å"transfer prices† to shift income away from the United States and shift deductible expenses into the United States (CTJ, 2006). Asset Protection: Multinational companies often use offshore ce nters to restructure their ownership of assets. Through trusts, foundations or through an existing corporation company wealth ownership can be transferred from people to other legal entities.Many companies which are concerned about lawsuits or lenders foreclosing on outstanding debts choose to transfer a portion of their assets to an entity that holds it outside of their home country. By making these ownership transfers, these companies can escape seizure or other domestic troubles (Investopedia, 2006) . Confidentiality: Many offshore jurisdictions offer multinational companies the added advantage of secrecy legislation. These countries have enacted laws establishing strict corporate and banking confidentiality.If this confidentiality is breached, there are serious consequences for the offending party. An example of a breach of banking confidentiality is divulging customer identities; disclosing shareholders is a breach of corporate confidentiality in some jurisdictions. To a multin ational company, this secrecy of personal information can offer significant financial and legal advantage. Because nations are not required to accept the laws of a foreign government, offshore jurisdictions are, in most cases, immune to the laws that may apply where the investing company resides (Investopedia, 2006).Diversification of Businesses: Domestic companies have to follow local government regulations that restrict its international investment opportunities. Before you choose a date, ask yourself:which date will work best with your schedule? Will you have any obligations or extracurriculars around that time? When are your college application deadlines? This guide introduces all upcoming ACT test dates for the 2018-19 testing year and also offers specific advice on the best possible dates for sophomores, juniors, and seniors. 2018 ACT Test Dates These fall and early winter ACTs are some of the best dates for juniors looking totake their first ACT. They’re also good for seniors who want to take the ACT a final time before their college applications are due. As for sophomores, most of these dates are too early and should be avoided. September 8, 2018 Registration Deadline: August 10, 2018 Late Registration Deadline: August 26, 2018 Sophomores This test date is at the start of the school year and is therefore too early for sophomores. As a sophomore, you won’t yet have studied the bulk of concepts tested on the ACT, so there won’t be much point in taking it this early. In addition, because most sophomores don’t know for sure where they’ll be applying to college just yet, you probably won’t have a concrete list of schools or a specific ACT goal score in mind. If you’d really like to get a head start on your ACT prep, you can use this time to begin some light studying: try out some official ACT practice questions, get familiar with the test format, and take a look at a few official practice tests. Juniors This is a great date for juniors to take their first ACT. By this time, you should be familiar with most ACT content. This date also gives you plenty of time to retake the ACT in the spring, summer, and/or fall of your senior year, if needed. (We recommend taking the ACT at least twice since you’re more likely to get a higher score on your second try!) Finally, this test date gives you the whole summer to prep for the ACT, which can be helpful if you're not a fan of studying during the school year and having to juggle classes and test prep. Seniors Seniors can use this test date to take their final ACT before college application deadlines. If you’re applying early decision or early action, this date easily allows you to get your ACT scores to your colleges in time. (Most early decision/early action deadlines are around November.) Furthermore, since you’ll have the whole summer to prep for the ACT, you won’t have to worry about balancing test prep with college applications. October 27, 2018 Registration Deadline: September 28, 2018 Late Registration Deadline: October 14, 2018 Sophomores Again, this test date is still early for sophomores. However, if you really want to get exposure to the ACT, you have three main options at this point: Option 1:Take a full-length ACT practice test.Doing this can help you learn more about the format and content of the exam. Just note that you won’t have studied all the concepts being tested on it yet. Option 2:Take the PreACT,which is a practice ACT for sophomores. This test is similar to the PSAT (a practice SAT), only it's not associated with a scholarship competition. The PreACT may be administered any time during the school year between September and June. Schools choose whether (and when) they want to administer it. To learn more about the PreACT and your high school's plans for it, speak with your guidance counselor. Option 3: Take the PSAT,which will be administered on October 10, 2018. Even though the PSAT is a practice test for the SAT and not the ACT, taking it can be a smart way to get in some general test-taking practice and help you determine whether you should take the SAT or ACT. It can also help prepare you to take the PSAT again as a junior when you'll be eligible for the National Merit Scholarship Program! Studying for both tests could easily overwhelm you- and might even confuse you, too, sincethe PSAT/SAT and ACT, albeit similar, are not identical in content or form. Seniors Seniors can choose this test date and still get their ACT scores to colleges in time. Since most regular application deadlines are January 1, this is a good time to take the ACT one last time should you want to. If you'reapplying early action/early decision, this date should work for most schools- but be aware that it'll likely be the last possible ACT you can take. Don't forget that you’ll be pretty busy around this time as you prepare your college applications, so I highly recommend opting for an earlier test date if possible. December 8, 2018 Registration Deadline: November 2, 2018 Late Registration Deadline: November 19, 2018 Sophomores Although this test date is still early for 10th graders,if you’re really curious about what the ACT is like, go ahead and give it a shot. Remember not to put too much pressure on yourself to get a high score; you still haven’t learned all the ins and outs of the concepts tested on the ACT, after all! Ultimately, it's still a better idea to just focus on taking ACT practice tests instead of taking the actual ACT. (Plus, you’ll save money!) Juniors While you can definitely take the ACT on this date, it might overlap with your finals, so I suggest taking it on one of the earlier test dates if possible. If you haven’t taken the ACT at all and really want to get your first one over with before spring, this is a solid date to choose. Just make sure you have a plan for balancing your finals with your ACT prep. Seniors This is the last possible ACT test date for most seniors. If you're applying regular decision, most colleges should be able to accept ACT scores from this date; some won't, though, so make sure to check with your colleges directly before you register for this test. As is the case for juniors, since this test date might overlap with your prep for finals, it's important to strike a healthy balance in your schedule so that you don’t overwhelm yourself. February 9, 2019 Registration Deadline: January , 2019 Late Registration Deadline: January 18, 2019 This test date is not available in New York. Sophomores You can take the test on this date if you really want to, but just know that it’s still pretty early for sophomores. You’ll likely struggle the most with the Math section, especially if you’re in Geometry class. If you’re in Algebra II or higher, however, you should know most of the math concepts being tested and could give it a shot if you're truly interested. Juniors Juniors can opt for this test date if they wish, but it’s most likely better to wait to take the ACT until spring, especially if it’s your second ACT and you took your first test back in the fall. Waiting for a spring test date will give you more time between tests to prep and hone your weaknesses so you can ultimately achieve a bigger score increase. Moreover, if you choose this winter test date, you’ll likely have to do a significant amount of ACT prep over your winter break. Seniors This is the final test date seniors can choose if applying regular decision at select colleges. Juniors This April test date is an excellent time for juniors to take the ACT for the first or second time, as it shouldn’t conflict with finals. Plus, by this point, you’ll have learned all the major concepts that are tested on the ACT. If this is your second ACT, you’re doing a great job of organizing your time. If you're able to hit your goal score on this date, you won’t have to retake the ACT and can instead use the summer to relax and focus on getting a head start on your college applications. If you still haven’t taken the ACT, however, I recommend doing so by this test date. This way, you’ll still have the whole summer to study and retake it at the end of summer or in the fall of your senior year should you need to raise your scores. Seniors Unfortunately, this test date is too late for seniors, as nearly all college application deadlines will have passed by this time. Be sure to get in your final ACT by December (or possibly February, depending on your colleges’ deadlines). June 8, 2019 Registration Deadline: May 3, 2019 Late Registration Deadline: May 20, 2019 Sophomores This is another great date for sophomores to take the ACT. With this date, you’ll get your ACT scores back by mid-summer and can use the rest of the summer to start prepping for a retake at the beginning of your junior year. The only big disadvantage is that this date might conflict with finals, which can make it tricky to prioritize your prep time wisely. Juniors This is another solid option for juniors, especially if you want to get the ACT over with before summer vacation. As I mentioned above, however, this test date could conflict with your finals, so make sure you’re using your time smartly and aren't overwhelming yourself with too many study sessions. Ideally, you’ll check your schedule before you register for this date so you can know exactly when all your tests are and when you can dedicate time to studying for each of them. If possible, I recommend opting for the April test date instead of this one, as that one is a lot less likely to coincide with finals and other important school tests. Their study found that someone with public speaking anxiety is more likely to overestimate the risk of negative social interactions in both frequency and impact. This makes sense from an outside perspective, but I still feel stubborn to admit any exaggeration on my part. This is the kind of information I will need to become more open to, so that I may benefit in the future. HR Management Challenges at Jaguar Land Rover 1. Introduction This report is being presented in response to a request by the Chartered Institute of Personnel and Development (CIPD) to analyse and assess some important HR implications of the current initiatives by some leading UK companies to send some of their brightest talent to work in emerging markets in order to gain fruitful international experience. Jaguar Land Rover, an iconic British company that has in the past gone through very difficult times and was purchased by the Indian TATA Group of Companies, has been steadily improving its operational and financial performance during past two years. Much of the companys growth is arising from its success in the newly developing emerging markets of the world. Whilst the company still has to make its presence felt in India, the home country of its new owners, its sales are steadily improving in countries like China and Russia, which have many high income individuals ready to spend on high performance luxury cars. The JLR management has recently initiated a proposal for sending some of its best senior managers to China and Russia to gain important international experience (Peacock, 2010, p 1). The company has further more informed its managers that strong experience in such international postings will improve their chances for progression to the board of directors. The Chinese market is extremely important to JLR, second in numbers only to the UK and the USA (Peacock, 2010, p 1). The company is also investigating the possibility of establishing a joint venture in China for the manufacture of thousands of cars (Bowman, 2010, p 1-2). With emerging markets like China, India and Russia becoming increasingly important to western business corporations, many British and American companies are actively investigating the idea of sending their managers to such countries to gain important international experience and insight (Bowman, 2010, p 1-2). JLRs proposal to send some of its key managers abroad was followed by the news of a survey of 418 UK executives that revealed that 40% of companies have plans to send more of their employees to emerging markets in East Europe, the Middle East, Russia and Asia (Bowman, 2010, p 1-2). Such proposals for systematic relocation of high quality organisational talent from home environments to overseas locations is bound to have a number of HR implications, not just from the individuals likely to be effected by such moves, but also by their bosses, who might not be willing to be deprived of bright employees working under them. Whilst such moves by UK companies are bound to have a number of organisational implications, this report deals with three specific HR issues namely, (a) organisational change, (b) cultural differences in international human resource management and (c) Talent Management. 2. Organisational Change Contemporary business organisations like JLR operate in extremely dynamic environments that are constantly being influenced and impacted by changes in technologies and in marketing and economic environments. JLR has in fact suffered extensively in the past because of its inability to respond adequately to global developments in the markets for luxury cars. Its takeover by the India based TATA group has been followed by a number of initiatives in different operational and marketing areas with good results. The company has decided to expand beyond its traditional markets in the UK and the United States and is actively searching for new markets in the Middle East, Russia, China and other emerging economies. Such changes in marketing strategies have been prompted and necessitated by the huge ongoing change in global economies and the expansion of wealth to the emerging and developing economies. Adoption of different organisational strategies often results in the need to bring about significant, long lasting and beneficial organisational change (Bovey, 2001, p 372). Such organisational change requires an identification of where an organisation should be, compared to where it is today, for achievement of strategic objectives, and the formulation and implementation of strategies to take the organisation from where it is to where it should be (Bovey, 2001, p 372). Whilst organisational change can be required on account of a number of environmental and marketing reasons, such change is essentially brought about through the agency of organisational managers and employees and needs to be viewed mainly through HR perspectives (Bovey, 2001, p 372). Numerous studies have confirmed time and again that the majority of organisational change initiatives are unsuccessful in achieving all or some of the original change objectives despite their being widespread agreement about the importance and relevance of such change (Hayes, 2006, p 87). Whilst some change initiatives may founder and lead to adverse consequences because they were essentially grounded in wrong decisions and inappropriate strategic thought, the majority of reasons behind the failure of otherwise important and desirable change initiatives largely occur because of various employee related issues (Hayes, 2006, p 87). There is general agreement on the fact that change initiatives brought about only through orders of senior managers are unlikely to be successful without strong support, involvement and participation of employees. Much of organisational resistance to change comes about from the apprehensions and insecurities of employees in being able to cope with the demand s of the planned changes. Such insecurities could arise from the prospects of having to learn new technologies, work in different locations, handle different people and exploit new markets (Hayes, 2006, p 87). The employees of JLR who are being asked to move to locations in China may well suffer from various apprehensions about the impact of such movements on their personal and professional lives. Such changes could lead to their having to be separated from their wives and children and working in different social, cultural, economic and legal environments (Hayes, 2006, p 87). Resistance to change is a much examined organisational phenomenon. Change management experts like Lewin and Kotter have advanced useful methods for implementation of organisational change. Lewin recommends a three stage change management process that consists of unfreeze, change and freeze stages (Lewin, 2005, p 14). Kotter on the other hand recommends that change should be brought in more gradually over the course of eight appropriate stages (Kotter, 2009, p 7). Whilst such tools for bringing about organisational change have been found to be useful, management experts assert that good change management stems out of effective leadership. Leaders are responsible for bringing about effective organisational change (Kotter, 2009, p 54). It is their responsibility to determine the change objectives, engage in transparent and clear communication about the need for change with organisational employees, identify and motivate change champions throughout the organisation, back change initiatives with physical and human resources and be committed to the achievement of the change objective (Kotter, 2009, p 54). JLR is in the process of implementing a number of change initiatives to improve its strategic processes, market share and operating efficiencies. The proposal to send its talented managers to an important business location like China in order to prepare them for board level positions is integral to such organisational change initiatives. The organisation leadership will have to take care to ensure the careful and appropriate implementation of such processes to achieve change objectives. 3. The Impact of Cultural Differences in International HR Management Globalisation, along with the liberalisation of isolated economies like those of the erstwhile Soviet bloc, China and India, has helped in the development of enormous business opportunities for western corporations (Zakaria, 2000, p 497). Western MNCs have being quick to spot the huge potential markets in these regions and have increased their marketing and production operations across Latin America, the Middle East, Russia and Asia, both to make use of their low cost economic environments and to exploit their growing and attractive markets (Zakaria, 2000, p 497). China represents an important destination for JLR and constitutes the third most important market for the company with potential for substantial future growth. The country is also an attractive destination for the establishment of economic production operations. Whilst the country is extremely important for the achievement of the organisations overall strategy, the success of such a strategy will be significantly influenced by the ability of the company and its managers to succeed in significantly different environmental conditions in China (Stulz, 2003, p 315). Whilst China is making strong efforts to integrate into the global economy, its social, cultural, economic, legal and political environment is significantly different from those of the UK and the USA (Stulz, 2003, p 315). MNC managers are required to handle numerous variables and deal with complex challenges in such foreign environments, many of which are not relevant in their home locations (Stulz, 2003, p 315). The need for such managers to operate in essentially different cultural environments is among the most significant of such challenges. The effect of such cultural differences on the functioning of expatriate managers is often extensive and is commonly termed as culture shock (Gallagher, 1996, p 228). HR experts state that culture shocks can not only affect the effectiveness of expatriate managers to succeed in their assignments, but t hat the ability of such managers to successfully operate in foreign conditions is largely dependent on their ability to recognise, plan for and overcome cultural differences (Gallagher, 1996, p 228). Cultural experts like Hofstede and Trompenaars have studied the issue in details and analysed specific reasons for such differences, which are unique to the social and cultural milieu of individual nations (Gallagher, 1996, p 228). It is important to appreciate that such cultural differences can lead to the emergence of frustration and feelings of strain, which can arise from not understanding the thoughts and actions of local people. Such strain and frustration can lead to anger, depression and helplessness (Maznevski, et al, 2002, p 276). International managers have to be trained to cope with the emotional, thinking and social aspects of cultural differences (Maznevski, et al, 2002, p 276). It becomes very important for organisations to engage in carefully planned and deliberated effo rts to orient their managers to deal with a vast range of cultural differences, especially so when managers have to be sent to countries with very different cultures (Stulz, 2003, p 315). The senior management of JLR must taker careful note of this aspect of international operations and engage in appropriate action, if it wishes to truly exploit the enormous opportunities available in China. 4. Talent Management Talent management represents a complex array of interrelated HR processes that are jointly used to improve the quality of organisational talent (Farndale, et al, 2010, p 32). With it widely being accepted that human resource constitute the most important organisational resource in modern day business, most well run organisations aim to utilise their human resources effectively by taking specific steps to sharpen and improve organisational talent (Farndale, et al, 2010, p 32). Mckinsey referred to this growing movement for improvement of organisational talent as the war for talent. With competition intensifying progressively across the world, most organisations realise that the maintenance and enhancement of competitive advantage is significantly dependent upon their ability to recruit, attract, develop and retain talent (Farndale, et al, 2010, p 32). JLR competes, in its segment of high priced luxury cars with globally famous competitors like BMW, Mercedes Benz and Toyota, all of whi ch are known for the superior quality of their managerial staff and workforce. JLR must also thus make deliberate efforts and adopt appropriate HR policies to nourish, nurture and reward its in house talent and make efforts to attract the best of external talent from outside. Its efforts to send employees who have been recognised on account of their superior management skills to China in order to develop them for senior organisational positions is an important HR process for development of organisational talent (Guthridge Komm, 2008, p 5). The exposure of these chosen managers to very different working and cultural environments will help them to understand different cultures and work with diverse types of people in alien environments (Guthridge Komm, 2008, p 5). Such exposure will help these employees extensively in understanding and appreciating the global economy and important company markets. It will also help them to obtain a world view and appreciate human diversity. Such experience should be invaluable in their development as professional managers (Guthridge Komm, 2008, p 5). Reward and remuneration policies also constitute an integral part of talent management processes (Briscoe, et al, 2009, p 46). Organisational talent not only has to be nurtured but also has to be rewarded handsomely in order to build organisational loyalty and retain it in house (Briscoe, et al, 2009, p 46). JLRs proposal to tie up assignments in China with positive weightage for future board level positions indicates its organisational policy to handsomely reward managers who are committed to organisational interest and personal and professional development. JLR must follow up its proposal to send these managers to China with transparent and clear communication on the reasons for doing so and how such an initiative will help the organisation as well as the individual managers. 5. For example in Act 3 During Antony speech he says   But Brutus says he was ambitious;   And Brutus is an honourable man.   He hath brought many captives home to Rome   whose ransoms did the general coffers fill:   Did this in Caesar seem ambitious?   When that the poor have cried, Caesar hath wept:   Ambition should be made of sterner stuff:   Yet Brutus says he was ambitious;   And Brutus is a honourable man.      By this it shows that Antony is intelligent and has courage for he mocks Brutus and his accusations. And it shows how he can manipulate the crowd by telling of Caesars wonderful accomplishments.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Antony then shows his anger towards the conspirators by getting the mob to release their anger by rioting and going out and killing the conspirators. Antony then starts a war against the conspirators and when this war starts Antony changes from the people’s hero to just a normal greedy leader. His hate for Brutus grows over time and with that hate grows greed. Antony starts thinking more about his wealth then about the people that he is supposed to be caring for.   In Act 5 Antony expresses his feelings towards Brutus before they go into the battle that will decide who is the rightful ruler of Rome.   Villains, you did not so, when your vile daggers   Hack'd one another in the sides of Caesar:   You show'd your teeth like apes, and fawn'd like hounds,   And bow'd like bondmen, kissing Caesar's feet;   Whilst damned Casca, like a cur, behind   Struck Caesar on the neck.

American Legal and Constitutional History

As residents or citizens of the United States of America, we enjoy certain rights that many people across the world do not have. One of those rights is freedom of speech, which is guaranteed to all of us through the United States Constitution. However, in some instances, our freedom of speech rights can be limited. One of those circumstances involves freedom of political expression. At this point, one would have to ask; how can a democratic country, which, like all other democratic countries, is based on freedom of speech, limit the same under certain conditions?In order to understand why and how this can happen, we will first examine the concept of citizenship and the Constitution of the United States as it relates to freedom of political speech. In addition to that, we will analyze how freedom of speech as it relates to politics can affect security and what affects current legislation has on freedom of speech. Based on the above-mentioned research, I intend to prove that compromisi ng freedom of political expression is a violation of the United States Constitution and as such cannot be allowed.Furthermore, I will argue that passing legislature such as the US Patriot Act can be very dangerous as it provides government with the power to violate our freedom of speech rights. Citizenship In the first part of the paper, we will examine and summarize the concept of citizenship. This is a very extensive process that is defined as â€Å"the process by which some people are included and others are excluded as members of the community† (Walker, 2002). In our country, everybody living here, regardless if citizen or not, enjoys the same protections from the law.The concept of citizenship is important because it associates us with our nation and with the law of the land. â€Å"Essentially, rights granted to citizens are typically represented by a continuum; however, the mere existence of citizenship does not necessarily equate to equivalent representation across th e board, often with glaring inconsistencies across similar geographic locations or historic periods, of which history is rife with examples. † (Gans 2005). So why is citizenship so important? Citizenship is important because it gives everybody the constitutional rights.Nobody can take them away from a United States citizen, regardless of his political views or statements. As United States citizens, we are entitled to a set of rights, which is unique in the world. The United States Constitution entitles us to those rights and guarantees that we can enjoy them. The United States Constitution is the set of documents that embody the principles on which the United States is governed. The Constitution is the supreme law of the land and no other law, at any level of government, can be established without considering the rules and rights as set forth in that document.The part that is especially important to American as it relates directly to their rights is the part of the Constitutio n that is known as the Bill of Rights. The first ten amendments of the United States constitution are more commonly referred to as the â€Å"Bill of Rights,† because they define specific rights that are granted to all United States citizens by the Constitution of the United States. â€Å"The Bill of Rights is modeled on many other similar documents, all of which owe their inception to the Magna Carta, the bill of rights written in England in 1215 CE.The Bill of Rights is considered to be an important part of the Constitution, and is also an integral part of popular culture; most Americans, for example, know what someone means when he or she â€Å"pleads the fifth,† a reference to the Fifth Amendment, which protects people from self recrimination. † (Smith 2003) The part of the Bill of Rights that is of concern to this paper is its First Amendment. According to the First Amendment there are actually several rights guaranteed to all citizens equally. Many people r emember two of them, the right to free speech, and the right to a free press.There are very few exceptions to free speech and fee press. Writing or speaking words that could be constituted as a threat to the American people or seriously threatening the life of someone can definitely lead to a civil law suit or even criminal prosecution. The right to free speech and free press fully includes any political expressions, regardless of what nature. So, if these rights are guaranteed to us, why do some people have concerns about political expression? Political Expression and limitations In wake of the 9/11 attack on United States a very controversial piece of legislation called â€Å"The USA Patriot Act† has been passed.The problem with this legislation lies in its definition of terrorism or terrorist activities. â€Å"The USA PATRIOT Act section 802 defines domestic terrorism so broadly that it could apply to an individual exercising his or her freedom of speech, expression, and assembly through acts of civil disobedience. The Department of Justice has not revealed how it is using section 802†¦ Moreover, Section 215 of the USA PATRIOT Act permits the FBI to seek records from bookstores and libraries of books that a person has purchased or read, or of his or her activities on a library's computer.This change puts people at risk for exercising their free speech rights to read, recommend, or discuss a book, to write an email, or to participate in a chat room, and thus could have the effect of chilling constitutionally protected speech. It also denies booksellers and library personnel the free speech right to inform anyone, including an attorney that the FBI has asked for someone's reading list. † (BORDC, 2008) Since then the BORDC has documented several cases where individual rights to free speech have been violated as a direct result of this legislature.Many of these violations have been triggered by political activity. For example â€Å"In June 2 004, Buffalo, New York, artist Steve Kurtz was detained by law enforcement and had his home searched by FBI agents. Despite finding only harmless substances, which Kurtz uses in his politically motivated art projects, the FBI proceeded with a Grand Jury hearing to decide whether to indict Kurtz under the USA PATRIOT Act’s biological agents provision. On June 29th, Kurtz’s bio-terrorism related charges (USA PATRIOT Act section 817) were dropped. † (BORDC, 2003)The above mentioned instance, along with similar mistakes have led many people to believe that our rights to free speech, including and especially the right to political expression, have been limited by legislature such as and similar to the Patriot Act. Many however argue that such laws are necessary in order to protect the greater good and help decrease the chances for renewed attacks on the United States. Another example of limitation of political expression involves a very recent incident at the Universi ty of Berkeley in California.The City Council sent a letter to the United States Marines recruiting office stating that their recruiters were not welcome in the city or on campus. This was just a letter of statement and it contained no threats or any other suggestions of violence, protests, or demonstrations. In return for this action, which was seen as very anti-patriotic by many politicians and citizens, various pressures were placed upon the city. â€Å"Some lawmakers were threatening to withhold millions of dollars of federal and state funding to the school as retaliation.They claimed that since U. S. Marines are not good enough for Berkeley, then neither were taxpayers’ dollars†¦ After receiving significant heat, the officials decided to recognize the officials’ right to be in Berkeley and clarified their position saying they support US troops — just not the war and the recruitment of young people. (Hill, 2008) The problem that we face here is that a political view of a cities population, as reflected in the council letter, was oppressed through threats of funding elimination.Even though the political view reflected in the letter is not popular and inappropriate, that was barely an exercise of free political speech that was suppressed by threats. The fact that this happened on a college campus, which should facilitate learning through open debate, makes it especially bad as it sends a statement that everybody should be politically in line with the main stream. â€Å"†¦in dealing with college campuses (as the cultivating grounds for those of the future) we should be more understanding when sentiments show up and give them room to thrive if they wish.Suppression, such as financial deprivation, is no way to deal with a situation and absolutely no way to stifle a conflict. † (Hill, 2008). This opens the question about why political expression matters and what is so special about it? Political Expression and Democracy In order to understand the impact of free speech on a democratic society we have to analyze the basics of democracy. â€Å"Freedom of speech and expression, especially about political and other public issues, is the lifeblood of any democracy.Democratic governments do not control the content of most written and verbal speech. Thus democracies are usually filled with many voices expressing different or even contrary ideas and opinions. † (U. S. Department of State, 2008) This statement is a very effective summary in reference to importance of free speech. As a democratic government, our leadership is supposed to lead is in direction that we chose. This choosing of direction is most often done through political debates as we see them on TV.â€Å"Democracy depends upon a literate, knowledgeable citizenry whose access to information enables it to participate as fully as possible in the public life of their society and to criticize unwise or tyrannical government officials or polici es. Citizens and their elected representatives recognize that democracy depends upon the widest possible access to uncensored ideas, data, and opinions†¦ For a free people to govern themselves, they must be free to express themselves — openly, publicly, and repeatedly; in speech and in writing. † (U. S. Department of State, 2008)What we have to understand is the fact that free flow of ideas through speech and other forms of communication is essential for the survival of a democratic government and as such, it cannot be compromised in any way. Free speech creates a pool of ideas that allow us to come to the bottom of every issue at hand by finding the truth. At the same time, we cannot afford to misunderstand this concept. Many people in history have favored freedom of speech, but only the kind of speech that they agreed with. This is why we had to deal with people like Hitler, Stalin, and Saddam.Their view of freedom of speech, especially when it came to politics, was definitely a one-way street. By using them as an example, we need to make sure that we focus on allowing all views to be expressed, regardless whether we agree with them. In my opinion, in this country, we cannot afford to place any limitations on freedom of political speech. Another issue that is directly related to the freedom of speech is freedom of belief. If the government or any other institution attempts to limit our freedom of political expression, then at the same time, they are prohibiting us from having the freedom to believe what we want.The concept is very simple. If we cannot freely express our ideas, then we should not have them in a first place. Many countries across the world had such a system in place. Saddam’s Iraq, Stalin’s Soviet Union and others. The reason these governments were called totalitarian was the fact that their citizens could not freely express their ideas and political views. This proves the fact that freedom of political expressi on is what makes us a strong democracy and that it should not be compromised. Many supporters of limited free speech cite various examples where it was necessary to limit political expression in order to achieve a greater good.One such example is Germany and many argue that by prohibiting political parties and any association with them (Nazi Party) was the right thing after World War II. I fully agree with that. However, when we cannot compare Germany and the United States (at least not back at that time). German people back then did not know the concept of democracy. Ones it was introduced they accepted it and Nazis never resurfaced again. In any case, my point is that in order to help nations such as post world war II Germany reach the right conclusion and adopt democracy some drastic measures may be necessary.However, these measures should never be undertaken on our soil. We have a healthy democracy and any limitations would disturb the balance. Even though it should never be com promised, freedom of speech has some limitations. One of the limitations that is relevant to political expression is the use of fighting words. The fact is that he inflammatory nature of some speeches can cause the listener to direct violence at the speaker or other target groups as defined by the speaker. Additionally, â€Å"fighting words† have become limited to speech directed to one person and not to speech directed generally at a crowd.The idea is that if a speech is going to cause harm to somebody or limit him or her in enjoyment of his or her constitutional rights in any way, then it is prohibited. Another major issue that has come out of this is the fact that many state universities prohibit speeches that are offensive to minorities. Universities have adopted those policies in order to respond to complaints of those who are subjects of hateful speeches. â€Å"That's the wrong response, well-meaning or not. The First Amendment to the United States Constitution protect s speech no matter how offensive its content.Speech codes adopted by government-financed state colleges and universities amount to government censorship, in violation of the Constitution. And the ACLU believes that all campuses should adhere to First Amendment principles because academic freedom is bedrock of education in a free society. † (ACLU, 2008) This is a very important issue that demonstrates how political views, questionable as they are, can be legally expressed everywhere, without government interference. Conclusion Free speech and expression of political ideas are the very basis of a democratic system.As a fundamental feature of a democratic society, freedom of speech as it relates to politics is subject to only few, clearly defined restrictions. I believe that democracy demands that also those who have undemocratic views must be allowed to propagate for their ideas. A democratic state may only interfere with the right to express a political opinion if it can prove that the direct result of their speech would be violence and harm to somebody. Freedom of expression is a prerequisite for democracy and therefore without freedom of expression, there can be no democracy.This is why it continues to be important to facilitate healthy debates on this issue and help people understand why it is important to respect opinion of others, even if it is not in accordance with the mainstream.
